Does self-exclusion cover every betting operator in Kenya?

It covers every licensed operator only if you choose that scope. Form 1 lets you tick all licensed operators, land-based premises only, online platforms only, or named operators. Licensees must check the national register, but the rules bind licensees and say nothing about sites that hold no Kenyan licence.

The short answer: the scope you choose sets the reach

A self-exclusion in Kenya is not automatically a ban from every betting business. What it reaches depends on the scope ticked on the application, and on whether the business holds a Kenyan licence. This guide separates those two questions.

The legal basis is section 115 of the Gambling Control Act, 2025. Subsection (1) lets a person who has recognised that their gambling is harmful enter a self-exclusion agreement with a licensee, to be excluded from all gambling establishments and all controlled games, including online gambling. The steps for applying are in the guide on how to self-exclude from betting in Kenya.

Four scopes on Form 1

Part B of Form 1, in the First Schedule to the Gambling Control (Conduct of Gambling Operations) Regulations, 2026, asks you to tick the scope of the exclusion. The table shows what each choice leaves open.

Land-based gambling premises onlyPhysical premisesOnline platforms
Remote or online gambling platforms onlyOnline platformsPhysical premises

If the aim is the widest cover the licensing system can give, the first row is the one that matches. The other three are narrower on purpose, and each one leaves something open.

How the register carries an exclusion to other licensees

Section 115(3) requires the Authority to keep a register of notifications and to notify all licensees of the agreement. Regulation 68 adds that the register must be accessible to all licensees through a secure electronic interface, and regulation 69(1) lists what each entry holds: the person's full name and identification details, the period, any additional restrictions the applicant specified, and the dates of registration and expiry.

Licensees have three further duties that make the register work in practice:

Read together, a licensee that is within the scope you ticked should refuse you even if you never used its own tool. These are duties on paper. This guide cannot confirm how far any particular operator has completed the integration, which regulation 73(1) gave existing licensees six months from commencement to finish.

Operator tools versus the registry

Regulation 87(2)(d) requires an easy to access option for self-exclusion for a period of at least twenty-four hours. That is a tool on the operator's own platform, and it is where many people first meet the idea. Because of regulation 87(2)(e), the tool is meant to link to the register, but the safe assumption is that a quick in-app pause reaches only that app until you confirm otherwise.

The registry route is different. You apply on Form 1, attach a copy of your national identification card or passport (regulation 70(2)), and the Authority enters your details. The lengths available are compared in the guide on self-exclusion periods from 24 hours to permanent.

What the register does not reach

The duties in section 115(4) and in Part IX of the regulations fall on licensees. An operator that holds no Kenyan licence is outside that structure: nothing in the texts makes it check the register, close your account or return your funds. The Act also makes it an offence under section 92(c) to publish or solicit any person to bet in an unlicensed gambling activity or site.

So the legal protection is only as wide as the licensed market. For the rest, protection is practical: delete apps, remove saved cards and mobile money shortcuts, and block betting messages. The guide on what happens to your balance when you self-exclude covers what a licensee must do with funds held.

Exclusions that someone else starts

The register can also hold exclusions you did not request. An operator may start one under regulation 75 and must tell the Authority within twenty-four hours. A court may issue an exclusion order under regulation 77, and subregulation (2) says such an order is binding on all licensed operators. A family member or other interested party may apply to the Authority under regulation 78, a route explained in the guide on a family request to block a betting account.

Regulation 75 is a decision by one operator. Unless it is reported and entered in the register, it should not be assumed to bind other businesses.

What an exclusion does not change

Excluded or not, the arithmetic of betting is the same: because of the bookmaker's margin, the average bettor gets back less than was staked. Exclusion changes access, not the maths, and it is not a way to win anything back. If betting is causing harm now, the responsible gambling page lists the GRA toll-free line and where to turn. Gambling is addictive; play responsibly, and only if you are 18 or older.

Questions and answers

If I exclude myself at one operator, am I blocked everywhere?

Not automatically. An operator's own tool applies to that operator's platform. Section 115(2) of the Act puts a duty on the person to notify the Authority of the agreement, and section 115(3) requires the Authority to register it and notify all licensees. Tick the all-operators scope on Form 1 if you want the registry to carry it across.

Does an exclusion stop me using betting sites that are not licensed in Kenya?

The Act and the 2026 regulations place the duties on licensees. They do not give the register any power over a site that holds no Kenyan licence, so such a site has no duty to check it. Removing apps, saved logins and payment details yourself is the only reliable barrier there.

Does a land-based exclusion also block online betting?

Only if you tick it. Form 1 offers land-based premises only and remote or online platforms only as separate scopes, so a premises-only choice leaves online platforms unaffected.

Who is in the register besides people who asked for exclusion?

Regulation 75 lets an operator start an exclusion, regulation 77 lets a court order one, and regulation 78 lets a family member or other interested party apply to the Authority. Regulation 77(2) says a court-ordered exclusion binds all licensed operators.

What if a licensee accepts a bet from someone who is excluded?

Under regulation 74(2) the licensee must refund all stakes to the person and forfeit any winnings to the Authority, and repeated violations can lead to suspension or revocation of its licence.
